FTA Published Notice Seeking Public Comment on Proposed Third-Party Contracting Guidance

The Federal Transit Administration has published a notice seeking public comment on proposed third-party contracting guidance.

The guidance governs how grant recipients award and administer contracts to third-party subcontractors or vendors. This updated circular would replace the current circular, which has not been revised since 2013.

The proposed updates reflect statutory and regulatory changes since the last update and provide additional non-binding guidance. FTA invites public comment on the proposed circular by Dec. 27.

The update provides new, non-binding guidance, specifying how the circular applies to different entities, including states, tribes, non-state recipients, and third-party contractors, and updating guidance on recipient responsibilities.

As contracts increasingly involve data collection, address data collection, ownership, and usage. Throughout the circular, revisions are proposed to clarify or reorganize sections for improved readability without substantively altering guidance from the current circular.
